1 This case was before this court on a prior appeal and the judgment reversed on the ground that plaintiffs in error were erroneously denied a jury trial, 208 Okl. 44, 253 P.2d 166. The plaintiff in the District Court is the plaintiff in error here and the parties will be referred to as they appeared in the trial court. The only question decided by this Court on the former appeal of this case, supra, was the defendants right to a jury trial on the issues, as shown by the pleadings, the Court stating in its opinion, 253 P.2d at page 167:
